REVISED Rules and Regulations for Pirate Cove Residents

Some important revisions have been made to our park rules for the betterment of our overall community. It is very important that you read, sign, return and obey.

RENTING OF HOME SITE Lot home sites are rented to residents who have completed an application, been approved, and signed a reoccurring annual lease.

RENT PAYMENTS Rent payments are due on or before the due date stated on the lease. Rent shall be paid in the form of a personal check, cashiers check, or money order. No Cash will be accepted unless an owner/manager approves. If lessee fails to pay the rent within five (5) days after the due date, Lessees will be assessed a Late Charge penalty of twenty-five dollars ($25) for each day the rent is in default. If the default continues for a period of ten (10) days after the due date, Lessee will be subject to immediate eviction. A returned check fee of thirty-five dollars ($35) plus any other bank charges suffered by the Lessor.

USE OF MOBILE HOME Homes are intended for the use of the immediate family or invited guests of the lessee. If a guest will be residing in the home for longer than 2 weeks, please notify management. Lessee is responsible for the behavior of all residents and guests in their home. If management considers occupants or guests conduct to be detrimental or incompatible with the health, safety, welfare, or common comfort and courtesy of others in the park, management reserves the right to require that occupant to vacate the park. Furthermore, the lessee will be held financially responsible for any damage caused to property in the park or management time caused by by children and guests in their home.

Renting of the home is strictly prohibited. Renting for any period of time will result in immediate eviction. Prepaid rent will not be refunded and the home will need to be moved out or sold within 30 days.

COMMON COURTESY  Music, televisions, parties, gatherings, or noise in general, must be kept to a volume that will not disturb neighbors. No loud yard work or noise prior to 8:00 am.

Public drunkenness, rowdiness, fireworks, gun fire, or general disturbing behavior will not be tolerated and may end up in immediate conviction.

DOGS/PETS All pets, including new pets, must be approved. No more then 2 pets permitted per home without written permission from management. If you feed an animal, it is considered your pet and must live in your home and on a leash when outside. No vicious breeds of dogs allowed. Pet owners are responsible to pick up after their pets.  $100 fee charged for first offense, any violations after could result further fees or eviction.

AMENITIES, complimentary

Residents and invited guests are welcome to use the common ground around the lake, waterfront docks, and pavilion for fishing or enjoying. No swimming or boating or entering the lake for any reason is permitted. Be courteous of those living lakefront and please do not cut through any yards to reach the water.

The lakefront  pavillion and the beautiful clubhouse are available for private events. Contact management to make a reservation. Free library open during office hours in the clubhouse. Swings, fire pit, waterfront dockside patio seating area, and grills located around the lake are all for residents and guests enjoyment.

 

EXTERIOR

Homes must be kept clean and neat on the exterior. Annual pressure washing or as needed, is required. Multiple yard ornaments, trash, lawn mowers, lawn maintenance equipment, unsightly items, basically anything other than typical outdoor furniture are not permitted. Management reserves the right to have home pressure washed, lessee responsible to pay.

Yards: Yards are to be kept well manicured, including grass cut and leaves raked.  Management reserves the right to have yards cut and maintained, if needed, at lessee's expense. The planting of trees, shrubbery, flowers, and landscaping is promoted and permitted. No Yard Sales.

Fencing: Fencing is not permitted. Any lot line (chains, ropes, wood rail, etc.) must be approved by management. Please visit the office for approved styles of lot line dividers. This must also be approved by the owner of the home on the adjacent lot. All current lot line dividers and decorative fencing may be subject for removal.

Trees: Residents are responsible to maintain the trees on their lots. This includes, trimming limbs over homes and cutting/removing dead branches. If any limb is touching or close to the power or cable lines, it is the resident's responsibility to call the utility company to have this taken care of. Before cutting any limb (larger than 3 inches) or tree, get approval from management. On occasion, Howard Enterprises will pay for tree removal. This is on a case-by-case basis.

Sheds: All sheds must be prebuilt off site, vinyl sided to match the home siding color or white and approved by management before entering Pirate Cove. Size and location need to also be approved. Some variances to this rule will be considered on a case-by-case basis.  All current sheds that are not in accordance with this rule, may be subject to removal or updating. It would be appreciated if you do have a shed that is not in accordance with this rule that you make updates by June 1, 2025, to keep Pirate Cove a beautiful place for all.

Carports: size, style, location and color, must be approved by management before bringing into Pirate Cove.

Decks, carports, porches, patios, steps, sheds: must be approved by management. The owner is then 100% responsible to hire a licensed contractor and obtain official permits. It is the homeowner's responsibility to obtain proper county permits prior to starting any project.

No enclosed additions are permitted. Any changes to current decks, screened porches or patios must be approved by management. All steps must be 36 inches wide. If the height is 30 inches or more, a handrail is required. All code requirements must be followed. Underpinning is required around homes, decks, and porches. White vinyl only.

Dumpsters usage (2): One is used only for household trash. No large items are permitted. Larger items must be taken out of the park to a recycle center. Cardboard boxes must be broken down. The second dumpster is for yard waste only. No large limbs or trees allowed. A fee of $100 will be issued for noncompliance. Habitual offenses will result in lease termination. These areas are under surveillance.

VEHICLES The SPEED LIMIT IS 10 MPH ON ALL ROADS IN PIRATE COVE whether posted or not for all vehicles. If a lessee, or guest of, speed in the park, a $100 fee will be charged for the first warning.  Habitual speeding will cause increased fees and possible lease termination.

Any vehicle that is not driven on a regular basis must be removed from the park. Major vehicle maintenance is prohibited in the park. Camping trailers &  RV’s are not permitted for parking (unless permission given), hook up or use. Oversized commercial vehicles are not permitted without special consideration from management. Each home has parking for 2 vehicles. Boats are allowed with permission, on a temporary basis. Some boats have been grandfathered depending on where the lot is located.

Motorcycles & Mopeds: If you or a visitor have a motorcycle, you must have permission from management to ride in the park and provide a picture of the cycle, license plate & drivers license. When traveling thru the park, cycles must go at a very slow idol speed, and quietly proceed direct to the home. No loud engine noise will be tolerated. If a rider doesn’t follow our strict noise and speed rule, their riding privileges as well as others in the household, will be revoked. THIS NEW RULE IS ON A TRIAL PERIOD, WE ARE WILLING TO TRY THIS NEW RULE AND SEE IF IT GOES WELL. IF IT FAILS, WE WILL GO BACK TO THE OLD RULE, of no motorcycles. This will be in the riders' hands if we can make this a success or not.

Golf Carts & misc. Street Legal Vehicles must have a licensed driver when in operation. Insurance/registration documents must be provided to management to receive park issued identifying numbered stickers. Stickers must be visible on the front and rear at all times. Speed Limit 10 MPH.  Golf Cart privileges can be revoked at any time for speeding or reckless driving. It is the responsibility of the operator to keep up with the local golf cart laws that are enforceable outside of the park.

Home Sales: All sales must go thru Pirate Cove Management even if the Seller knows or is related to the Purchaser. A 6% commission and $3,000 transfer fee will be included in the list price of the home and paid by the Seller at closing. Resales are subject to a professional inspection to determine that they are in condition to be sold. This is at the discretion of management. If a home is sold without going through Pirate Cove Management, immediate eviction will ensue. The home will need to be removed immediately, no refund of any rent will be issued, and the lease will be void.

Responsibilities: Howard Enterprises and Pirate Cove Management is not responsible or liable for any personal injuries in Pirate Cove, or the lake or for fire, theft, or property damage of any form. This includes damage from dead or alive trees or limbs. Residents must provide annual proof of current homeowners/liability insurance to management.

Howard Enterprises and Pirate Cove Management reserve the right to add to or alter these rules and regulations, written or unwritten, should any unusual circumstance arise.

Important Suggestion: Please make sure that your executor or close family member knows where your title is and consider changing the title to include your Executor or Power of Attorney as OR on the title if in the unfortunate event of your passing. A copy of your title would be beneficial to have in your file in the office.
